§ 1 Scope

These General Terms and Conditions (GTC) apply to all contracts for services provided by DRAICO UG (haftungsbeschränkt), operating under the name BESENREIN KA (hereinafter “Contractor”), with its customers (hereinafter “Client”). Deviating terms of the Client only become effective if the Contractor expressly agrees to them in writing.

§ 2 Conclusion of contract and quote

Quotes from the Contractor are non-binding. A contract is concluded through written or verbal confirmation of the order or upon commencement of the work. The basis of the service is usually a fixed-price quote prepared after an inspection.

§ 3 Scope of services

The scope of services (gutting, clearance, final cleaning) is set out in the respective quote or order confirmation. Additional services not agreed upon are charged separately and must be agreed in advance.

§ 4 Prices and payment

The fixed prices stated in the quote apply. Unless otherwise agreed, invoices are due for payment without deduction within 14 days of the invoice date. All prices include the applicable statutory VAT unless otherwise stated.

§ 5 Appointments and Client cooperation

Agreed appointments are kept whenever possible. The Client ensures unobstructed access to the property and arranges any necessary permits (e.g. no-parking zones). Delays for which the Client is responsible may lead to additional costs or rescheduling.

Collection guarantee for the bin service. If the bins are not put out in time on an agreed collection day for reasons for which BESENREIN KA is responsible, no fee is charged for the calendar month concerned. This requires the Client to report the missed collection within 48 hours via WhatsApp, email or phone, and to have provided the collection calendar and any changes in good time. Excluded are cases in which access to the bin site was blocked, the waste service changed the date without public notice, and force majeure, storms or ice that make safe placement impossible. The guarantee applies to at most one month per calendar year; further claims (e.g. costs of an extra collection) remain subject to § 7.

Trial month. The Client may terminate bin service contracts at any time without notice within the first month of the contract. Services already provided are charged pro rata. After the first month, the contract can be terminated at any time with 30 days’ notice.

§ 6 Disposal and ownership

Unless expressly agreed otherwise, the items taken over during the clearance are deemed released for disposal or recycling. The Client warrants that they are entitled to dispose of the items. Valuables and personal documents must be removed by the Client beforehand.

§ 7 Warranty and liability

The Contractor is liable under statutory provisions for damages resulting from injury to life, body or health as well as for intent and gross negligence. Otherwise, liability is limited to the foreseeable damage typical for the contract. The Contractor carries liability insurance. Obvious defects must be reported in writing without delay, at the latest within 7 days of service delivery.

§ 8 Right of withdrawal for consumers

For contracts concluded off-premises and distance contracts, consumers have a statutory right of withdrawal of 14 days. The Contractor provides details separately in the withdrawal instructions. At the express request of the consumer, the service may begin before the withdrawal period expires.

§ 9 Final provisions

The law of the Federal Republic of Germany applies. Should any provision of these GTC be invalid, the validity of the remaining provisions remains unaffected. The place of performance is, where legally permissible, the Contractor’s registered office in Karlsruhe.
